Joint Civil Judge S S Shinde of the Pune Civil Court on Wednesday asked the court to issue notices to Baba Kalyani and Gaurishankar Kalyani regarding a partition suit filed by their sister, Sugandha Hiremath.
The court was hearing a partition suit filed by Hiremath, seeking a one-third share of the Kalyani HUF (Hindu Undivided Family) wealth. The notice allows the Kalyani brothers to respond to her claims.
On Wednesday, Hiremath’s counsel also requested the appointment of a receiver to manage the promoter shares of Kalyani group companies. She urged the court to appoint an administrator and/or receiver relating to the voting rights, as well as the sale and transfer of the shares across all group companies. In the partition suit filed last month, Hiremath alleged that her brothers, Baba Kalyani and Gaurishankar Kalyani, controlled these promoter shares and had been selling, transferring, and alienating the shares and other family assets over the years.
The counsel argued that the wealth in the Kalyani family was derived from the initial wealth of their grandfather, Annappa Narayan Kalyani, which was passed down to his son, Neelkanth Kalyani, and then to his grandsons, Baba Kalyani and Gaurishankar Kalyani.
During the hearing, the court listened to Hiremath’s counsel regarding the appointment of a receiver and stated that it would issue notices to the other parties involved before passing any orders.
Baba Kalyani has denied the existence of any family wealth or the Hindu Undivided Family status. “The papers in the new suit have not been served upon us, so it is premature to comment on the particulars. However, this new suit appears to be a second attempt by Sugandha, who has been unsuccessful in all her previous claims against us. We will appropriately defend against the new suit,” a Kalyani spokesperson stated.
