JSW Renew Energy Five, a subsidiary of JSW Energy, has filed an appeal with the Appellate Tribunal for Electricity (APTEL) challenging the Central Electricity Regulatory Commission’s (CERC) decision to reject the tariff adoption for its BESS pilot project dated January 2, 2025, according to people familiar with the matter.

The matter pertains to CERC’s rejection of the capacity charge/tariff of Rs 1,083,500 per MW/month discovered through a transparent e-reverse auction in August 2022. The project in question is a first-of-its-kind battery energy storage system (BESS) pilot supported by the Power System Development Fund (PSDF). JSW Renew Energy emerged as the successful bidder for two 250 MW units.
CERC declined to adopt the tariff, arguing it was misaligned with subsequent market rates observed in later tenders held between 2024 and 2025.
A mail sent to the company did not elicit any response.

“The appellant (JSW Energy subsidiary) contends this decision undermines the sanctity of the bidding process, penalises developers for delays not caused by them, and ignores that costs discovered in later auctions are irrelevant to the original bid timeline. The delay was attributed to procedural and regulatory hurdles from CERC and associated parties,” the company said.
